By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of the Service

Poker [AI]dvisor is an AI-powered poker analysis tool that allows users to:

  • Upload or create poker hand histories
  • Receive AI-generated analysis of poker hands and tournaments
  • Save and review past analyses
  • Track usage and improvement over time

The Service is provided for educational and entertainment purposes. It is not a gambling service and does not involve real-money wagering.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

4. Account Registration

To access the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Plans and Pricing

5.1 Free Plan

Free users receive a limited daily quota of analyses with a default AI engine configuration.

5.2 Premium and Platinum Plans

Paid plans offer higher quotas, engine speed customization, and additional features. Pricing and plan details are displayed on the pricing page and may be updated from time to time.

5.3 Billing

Paid subscriptions are billed on a recurring basis (monthly or as specified). You authorize us to charge the applicable fees through our payment processor.

5.4 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods, except where required by applicable law.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Use automated scripts, bots, or scrapers to access the Service
  • Circumvent usage quotas or rate limits
  • Share your account credentials with third parties
  • Upload content that is malicious, abusive, or infringes third-party rights
  • Interfere with the operation or security of the Service

We reserve the right to suspend or terminate your access if you violate these terms.

7. Intellectual Property

7.1 Our Content

The Service, including its design, code, AI models, branding, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7.2 Your Content

You retain ownership of the hand histories and data you upload. By using the Service, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing the Service (generating analyses, storing your history, etc.).

7.3 AI-Generated Content

AI analysis outputs are generated by third-party AI models. These outputs are provided to you for personal use. We do not claim ownership of the AI-generated analysis results.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to:

  • Accuracy, completeness, or reliability of AI analysis
  • Fitness for a particular purpose
  • Uninterrupted or error-free operation

AI analysis is not a substitute for professional poker coaching or solver-based analysis. The outputs are approximations based on AI models and should be used as educational guidance, not definitive strategy.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for any decisions you make based on AI analysis outputs, including financial losses from poker play

10. Data Protection

Your personal data is processed in accordance with our Privacy Policy, which forms an integral part of these Terms. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

11. Availability and Modifications

We reserve the right to:

  • Modify, suspend, or discontinue any part of the Service at any time
  • Update these Terms with reasonable notice
  • Change pricing for paid plans (existing subscribers will be notified in advance)

Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Termination

12.1 By You

You may delete your account at any time. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

12.2 By Us

We may suspend or terminate your account if you breach these Terms, with or without prior notice depending on the severity of the breach.

13. Governing Law and Disputes

These Terms are governed by the laws of France. Any dispute arising from these Terms or the Service shall be submitted to the competent courts of Nanterre, France, unless mandatory consumer protection laws provide otherwise.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
